Terms of service
Agreement
These terms are between Rubrical (operated by OpenKit Ltd, company number 13030838) and the school or individual using the platform. By creating an account or using Rubrical, you agree to them. Where a separate signed agreement exists with your school, that agreement takes precedence.
The service
Rubrical provides AI-assisted marking, feedback, lesson planning and analytics for teachers. Rubrical drafts marks and feedback for a teacher to review; the teacher is responsible for the marks and feedback returned to students.
Accounts
You are responsible for keeping account credentials secure and for activity under your account. Tell us promptly if you believe an account has been compromised.
Acceptable use
- Use Rubrical only for legitimate teaching and assessment.
- Do not upload content you have no right to use, or attempt to disrupt or reverse-engineer the service.
- Do not use Rubrical to make solely automated decisions about a student without teacher review.
Your data and content
Your school keeps ownership of the assessments, rubrics and student work it puts into Rubrical. You grant us the permissions needed to provide the service. We handle personal data as described in our privacy policy and data processing agreement.
Availability
We work to keep Rubrical available and reliable, but the service is provided on an "as available" basis and may occasionally be interrupted for maintenance or events beyond our control.
Fees
Paid plans are billed as set out in your school's order or quote, and free use is offered for a single class. The fees and what each plan includes are confirmed in that order or quote, or when you get in touch.
Liability
Nothing in these terms limits liability where it cannot lawfully be limited. Otherwise, our liability is limited as set out in your school's agreement with us. Rubrical assists teachers; it does not replace professional judgement, and final responsibility for marks and feedback rests with the teacher.
Termination
Either party may end the agreement in line with its terms. On termination we will delete or return your data according to your instructions and our retention policy.
Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
